Jasmine Moxey-Butler, Partner and Head of our Police Claims Department, has successfully recovered a four figure sum in damages for a client who was the victim of gross misconduct by a serving police officer.
Police officers attended our client’s home in relation to an unrelated matter and carried out a search in her property. During that search, one of the attending officers entered our client’s bedroom and removed an item of a personal nature from a drawer, placing it in his pocket. The shocking act was captured on our client’s Ring video camera. The police officer later resigned from Hertfordshire Constabulary while under investigation.
The police officer was charged with theft and corrupt/improper exercise of police powers and privileges. He pleaded guilty to both charges and was jailed for four months.
A formal complaint was made to the Independent Office for Police Conduct (IOPC). The Professional Standards Department (PSD) further confirmed that his actions amounted to a serious breach of professional conduct, and that the matter would proceed to an Accelerated Misconduct Hearing.
Following a misconduct panel, Hertfordshire Police confirmed that the officer would have been dismissed had he not already resigned.
Our client was understandably distressed by the invasion of her privacy and the complete abuse of trust by a serving police officer. With Jasmine’s assistance, she was able to pursue a civil claim against the police and received compensation for the harm she suffered. All it took was a well-drafted letter of claim, demonstrating the strength of her case and the clear wrongdoing involved.
