If you are thinking about making a police assault compensation claim then you may find the following case of interest.
An on-duty police Inspector was seen assaulting a male during a road rage incident on the A46 between Newark and Lincoln. Footage recorded by the victim’s partner showed that the Inspector physically grabbed at, and wrestled the victim to the ground prior to throwing punches, stamping on his feet and using abusive language.
Initially, the force’s Professional Standards Department declined to charge the Inspector. However, this was successfully appealed which them prompted a disciplinary hearing. The disciplinary hearing concluded that the Inspector’s actions amounted to gross misconduct and deemed his conduct to be “unnecessary, unreasonable and disproportionate”. The Inspector was cleared of common assault, but while he had already resigned from the force, it was noted that he would have been dismissed had he remained in position.
The victim in this case rejected an initial offer of £50,000, and an improved offer of £70,000, before the matter was settled for £100,000 plus legal costs.
The case illustrates that:
- Even when criminal charges fail, civil compensation remains attainable.
- Holding a police force to account requires robust evidence and perseverance.
- A well-prepared civil claim can secure both compensation and public accountability.
